Mygate Premium T&Cs

Welcome to the terms and conditions (“Terms”) for Mygate Premium Plans. These Terms are between you and Vivish Technologies Private Limited (“Mygate” / “Us” / “We”) and govern our respective rights and obligations.
Please note that your use of the subscription to Mygate Premium is also governed by the Terms of Use and Privacy Policy of Mygate, all of which (as changed over time) are incorporated into these Terms. If you sign up for a Mygate Premium membership, you accept these terms, conditions, limitations and requirements.

Eligibility Criteria

  • By signing-up for Mygate Premium membership, you confirm that you are a resident of India and above the age of 18 years.

Membership Plans

  • You may select the Mygate Premium membership plan of your choice and you can change the plan at any time. The payment method(s) eligible to be used for different membership plans may vary, and We reserve the sole right to determine the eligible payment methods for each membership plan.
  • The membership fee and benefits for Mygate Premium are stated in our website, for different membership terms, such as a monthly or annual Mygate Premium membership, which are offered.

Subscription and Payment

  • The Mygate Premium membership fee is non-refundable except as expressly set forth in these Terms. Your paid membership will be activated only on successful payment to Mygate.
  • Taxes may apply on either or both of the membership fee and other benefits availed by You through Mygate Premium.
  • You can make a single-time purchase of Mygate Premium individual membership for a fixed time period on a non-recurring basis using the pre-paid plans. Your Mygate Premium membership will be renewed consecutively for such terms, monthly or annual as chosen by you, (such renewal, “Auto Renewal”), if the payment method you have chosen for making payments towards your Mygate Premium membership supports Auto Renewal. In cases where you select an eligible payment method, the payment of the membership fees will be on a recurring basis (such payments, “Recurring Payments”) and you authorize us to collect the membership fee for the next membership terms(s). In case Recurring Payments are not possible or permissible on the last subscription day of the existing term, Once the time period you purchased ends, the pre-paid plan will automatically terminate, and you will lose access to your benefits. To maintain access to your benefits, you will need to make another purchase or switch to a different plan.
  • You may contact our support team to terminate access to the prepaid plan. Note that once your access is terminated, you will no longer have access to your benefits unless you re-subscribe. No partial refunds are available.
  • Pre-paid plans are currently available on Android and iOS only in India.
  • Pre-paid plans cannot be combined with other Premium offers including family subscription and free trials offered by Mygate. Pre-paid plans may be subject to limited time introductory offers.
  • Price may vary by user or subscription or duration of term. Mygate reserves the right to change the price at any time without notice.

Termination

We may terminate your Mygate Premium membership at our discretion without notice. If we do so, we will issue a credit note to you and give a prorated refund based on the remaining term of your then membership term, whether annual or monthly. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Mygate Premium membership, or is harmful to our interests or another user. It is clarified that if the Auto Renewal of your membership is enabled, you will be provided a refund (in accordance with these Terms) only for such membership term for which you have been charged. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

Other Limitations

  • We reserve the right to accept or refuse or cancel or suspend any membership at our discretion.
  • We may send you email, and other communications (including phone calls and SMS) related to Mygate Premium and your Mygate Premium membership (regardless of any settings or preferences related to your Mygate Premium account).
  • You may not transfer or assign your Mygate Premium membership or any Mygate Premium benefits whatsoever.
  • From time to time, Mygate may choose in its sole discretion to add or remove or change Mygate Premium membership benefits and eligibility criteria.
